Terms of Sale

These Terms of Sale apply to orders placed on the naked-underwear.com website and delivered in the United States.

Article 1: Seller

The naked-underwear.com website (the "Website") is operated by NAKED Underwear (the "Seller", "we" or "us").

Article 2: Scope

These Terms of Sale govern all sales of products on the Website between the Seller and any consumer (the "Customer", "you"). By placing an order, you accept them. They do not limit any rights you have under applicable law.

Article 3: Products

Each product page shows the main features of the product: description, composition, sizes and colors. Photos illustrate the products. Colors may look slightly different depending on your screen. The composition of each item is on its product page and on its label. If in doubt, contact customer service before ordering.

Article 4: Prices

Prices are in US dollars (USD). They do not include sales tax or shipping. Sales tax, where it applies, and shipping costs are shown at checkout, before you confirm your order. The price that applies is the one shown on the Website when you confirm your order.

Article 5: Orders

To order, select your products, add them to your cart, enter your contact details and shipping address, choose a payment method and confirm. Before confirming, you can check the order details and the total price, and correct any mistakes. The sale is concluded when you confirm your order. You then receive a confirmation e-mail with a summary of your order.

We may refuse an order for a legitimate reason, such as proven fraud or an ongoing payment dispute.

Article 6: Payment

Full payment is due when you order. You pay online with the methods shown at checkout, such as credit or debit card. Certified payment providers secure every transaction. We never see your full card details. If a third-party provider offers payment in installments, that provider's terms apply.

Article 7: Shipping

We ship to the address you enter at checkout, in the United States. Most orders are prepared and handed to the carrier within 48 business hours. The estimated delivery time, processing included, is 7 to 15 business days. Shipping options and costs are on our Shipping Policy page and at checkout.

If your order is not delivered within 40 days, we refund it in full or reship it, your choice.

The risk of loss or damage passes to you when you, or someone you designate, take physical possession of the products. Please report a damaged or incomplete package to customer service as soon as possible.

Article 8: Returns and exchanges

You have 14 days from delivery to tell us about a return. Lingerie can be exchanged or returned for a store credit; for hygiene reasons, it is not eligible for a cash refund. Other items can be refunded or exchanged. Return shipping is paid by you, except for a defective item or an error on our part. All details are in our Return Policy.

Article 9: Defective items

If a product is defective or is not what you ordered, contact customer service at contact@naked-underwear.com. We offer a replacement or a refund, and we cover the return shipping costs. Nothing in these Terms of Sale limits any warranty rights you have under applicable law.

Article 10: Customer service

Send any question or complaint to contact@naked-underwear.com or through the contact form on the Website. Customer service confirms receipt and replies as soon as possible, generally within 24 to 48 business hours.

Article 11: Personal data

We process your personal data as described in our Privacy Policy.

Article 12: Intellectual property

All content on the Website (trademarks, images, texts, logos) is protected by intellectual property law. It belongs to the Seller or its licensors. Any use without our permission is prohibited.

Article 13: Liability

We are responsible for fulfilling your order. We are not liable when a failure is caused by you, by the unforeseeable act of a third party, or by force majeure. Nothing in these Terms of Sale limits or excludes rights you have under applicable law.

Article 14: Governing law and disputes

These Terms of Sale are governed by the laws of the State where you reside. If a dispute arises, please contact customer service first so we can find a solution together. If no solution is found, the dispute is brought before the competent courts of your State of residence. The reference language of these Terms of Sale is English.

Article 15: Miscellaneous

If any provision of these Terms of Sale is found invalid or unenforceable, the other provisions remain in effect. We may update these Terms of Sale. The version that applies to your order is the one in force on the day you placed it. You can ask us for a copy.
